Petitioner renews his prayer for bail in connection with S.T. No. 649 of 2019 arising out of Bhadaur P.S. Case No. 61 of 2018 registered for the offence under Sections 304(B) / 201 / 34 of the I.P.C. inasmuch as bail application of the petitioner was earlier rejected by a Co-ordinate Bench of this Court in Cr. Misc. No. 64663 of 2019.
Petitioner happens to be the husband of the deceased , who allegedly with the help of his other family members killed his wife on account of non fulfillment of illegal demand of dowry within seven years of marriage.

No.35183 of 2021(2) dt.04-01-2022 2/3 This Court while rejecting the bail application of the petitioner had granted him liberty to renew his prayer for bail after seven months if the trial does not conclude. Learned counsel for the petitioner submits that petitioner is in custody since 05-10-2018, the trial is still pending and only one witness out of eight witnesses has been examined, who has been declared hostile. He next submits that trial is not likely to be concluded in near future and the petitioner remained in custody for more than three years. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the period of custody (i.e.
more than three years) and the fact that only one witness has been examined out of eight witnesses, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II Barh, Patna in connection with S.T. No. 649 of 2019 arising out of Bhadaur P.S. Case No.
Patna High Court CR. MISC. No.35183 of 2021(2) dt.04-01-2022 3/3 and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
