The petitioner, Mahendra Manjhi, is apprehending his arrest in Kinjar P.S. Case No. 17/2014 registered under Section 307 and other sections of the Indian Penal Code and Section 47(A) of the Excise Act.
There is allegation that while the police was raiding the house of Anuja Devi and Sabua Devi, the petitioner along with other villagers came and started pelting stones on the police party. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. Co-accused Hajari Manjhi, Ganauri Manjhi and Sabua Devi have already been enlarged on anticipatory bail by a bench of this Court vide Cr. Misc. No. 44315 of 2014 and Cr. Misc. No. 24458 of 2014. Considering the fact that on same and similar facts
Patna High Court Cr.Misc. No.2208 of 2015 (2) dt.19-01-2015 2/2 the aforesaid co-accused have been granted anticipatory bail, let the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, be released on anticipatory bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deshmukh, Judicial Magistrate 1st Class, Jehanabad in Kinjar P.S. Case No. 17/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
