JUSTICE BIRENDRA KUMAR ORAL ORDER 19-05-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of anticipatory bail for offence under Sections 302 and 120/34 of the Indian Penal Code 27 of the Arms Act.

The informant is not an eye witness of the murder. He has suspected the named accused persons in the first information report. The petitioner is not named in the first information report. Name of the petitioner has transpired during investigation for the reason of enmity with his own brother. First information report named coaccused, Jamshed Mian, has already been allowed regular bail by a coordinate Bench of this Court in Cr. Misc. No. 32838 of 2013.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Magadh Medical P.S. Case No. 40 of 2013 to the satisfaction of the Additional Chief Judicial Magistrate, IV, Gaya, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
