The petitioner seeks bail in connection with Udakishunganj P.S. Case No.398 of 2023 registered for the offence under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner along with other co-accused persons is to have assaulted the informant and others by means of lath, danda, iron rod, etc. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that allegation as regard to causing injury to Durga Yadav by means of iron rod

Patna High Court CR. MISC. No.27293 of 2024(2) dt.20-04-2024 2/2 and lathi is against this petitioner along with two other coaccused persons. It is submitted that it appears from injury report that doctor found three injuries upon the injured, namely, Durga Yadav, where, two injuries are simple in nature and one injury kept reserved and the injuries were caused by hard and blunt substance. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 19.12.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Udakishunganj P.S. Case No.398 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Udakishunganj, Madhepura.
