This application, for grant of anticipatory bail, arises out of Kotwali (Tilkamanjhi) P.S. Case No. 527 of 2015, disclosing offences under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.
Allegation against the petitioner is of fraudulent withdrawal from the Bank account of the informant by mysteriously taking his A.T.M. card and misusing that by way of replacing his own card with the informant's A.T.M.
Patna High Court Cr.Misc. No.41020 of 2016 (9) dt.26-09-2016 2/2 card.
Considering the nature of offence, I am not inclined to grant the petitioner, above named, the privilege of anticipatory bail.
This application is, accordingly, rejected.
The petitioner is directed to surrender before the learned court below, in connection with Kotwali (Tilkamanjhi) P.S. Case No. 527 of 2015, within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
