====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dandkhora P.S. Case No. 57 of 2018 instituted for the offence under Sections 323 and 376/34 of the Indian Penal Code.
The informant has alleged that petitioner on the pretext of performing marriage established physical relationship with her. It is further alleged that petitioner brought her to his house on 1.4.2018 for performing marriage. The parents of the petitioner demanded Rs.50,000/- and ousted from the house. Thereafter, the informant returned to her father's house and narrated the occurrence.
Counsel for the petitioner submits that now good sense has prevailed between the parties and compromise petition has been filed in the court below which finds
Patna High Court Cr.Misc. No.74432 of 2018(2) dt.17-12-2018 2/2 mentioned in the impugned order.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned a.D.J. 1st cum Special Judge, Katihar, in connection with Dandkhora P.S. Case No. 57 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
