The trial court has reported that the trial of the petitioner has already commenced and one prosecution witness has already been examined.

Therefore, taking note of the aforesaid facts as well as the allegation, levelled against the petitioner, I am not inclined to release him on bail and accordingly, his prayer for bail in connection with Bajpatti P.S. Case No. 223 of 2015, Trial No. 2097 of 2016 stands rejected.

However, the trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible, preferably, within four months from the date of receipt/production of copy of this order.

No.46430 of 2016 (3) dt.07-12-2016 2/2 It is made clear that if, trial court fails to conclude the trial of the petitioner within the period as stated above due to noncooperation and laches of the prosecution, the petitioner may renew his prayer for bail before the learned trial court itself.
