2. The petitioner apprehends arrest in a case registered under Section 30(a) of Bihar Excise Act.

3. As per prosecution case, 71.250 liters illicit liquor was recovered from potato and maize field of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case only on suspicion. Further submission is that nothing has been recovered from the conscious possession of the petitioner. The recovery has been made from an open place easily accessible to public at large. Petitioner has got no criminal antecedent and he undertakes to

5. Learned A.P.P. for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, submissions of learned counsel for the parties and fair antecedent of the petitioner, let the above named petitioner be released on bail, in the event of arrest or surrender before the Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 3, Motihari, East Champaran in connection with Madhuban P.S.
