In this case, the petitioner is making prayer for quashing the letter No.79 (NEE) dated 09.01.2013 passed by the District Programme Officer (Establishment), Supaul, whereby the petitioner had superannuated before attaining the age of 60 years. Claim has been made by the petitioner that his case is covered by the order passed in C.W.J.C. No.5424 of 2012 and C.W.J.C. No.16979 of 2014 (Annexure- 4 and 5 to the present writ application).
This Court is not giving any opinion on the merit of
Patna High Court CWJC No.25165 of 2013 (3) dt.02-05-2016 2/2 the case. The authority will examine the case of the petitioner. If it is found that the case of the petitioner is covered by the aforesaid two decisions, the petitioner will be extended the same benefit as has been extended to the petitioners of aforesaid cases. The authority will decide the matter within a period of three months from the date of receipt / production of a copy of this order. With the aforesaid observations and directions this writ petition is disposed of.
