JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kasba Police Station Case No. 55 of 2014 registered for the offences punishable under Section 307 and other minor section of the Indian Penal Code.
Admittedly, both parties lodged cases against each others. It is also an admitted position that informant is full brother of petitioner no.1. The first information report discloses that it was co-accused Sumit Kumar, who gave rod blow on the nose of injured Govind Swarnkar. It appears that except one grievous injury Govind Swarnkar has sustained simple injury. Admittedly grievous injury has been caused to him by co-accused Sumit Kumar. So far as rest injured is concerned, they sustained simple
Patna High Court Cr.Misc. No.627 of 2015 (2) dt.08-01-2015 2/2 injury.
Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Purnea in Kasba Police Station Case No. 55 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
