The petitioner seeks bail in Harnaut P.S. Case No. 156/2018 instituted for offences under Section(s) 365 and 34 of the Indian Penal Code. Later on Sections 364, 302, 201 and 120(B) of the Indian Penal Code were also added. Learned counsel for the petitioner has submitted that petitioner is lady. She is not named in the written report. Police after investigation has not submitted charge-sheet against this petitioner although cognizance has been taken against this petitioner by the court below.

It is alleged in the written report that on the date of occurrence one Manish Kumar took the brother of informant with him on motorcycle. Thereafter the informant came to know

Patna High Court Cr.Misc. No.73157 of 2018(2) dt.07-12-2018 2/2 that his brother and Diwakar Kumar had gone to Deepak Kumar at village Dihra. Manish Kumar had also gone there. Since then there is no information about the brother of informant. The informant made attempt to contact with his brother on his mobile but the same was switched off. The informant raised suspicion that Manish Kumar and his brother Chandan Kumar have kidnapped his brother.

Petitioner is in custody since 06.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 156/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
