JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the O.P. No.2 State Bank of India, Garhpura Branch, Begusarai. This application has been filed on behalf of the petitioner for modification in the order dated 12.07.2016 passed in Criminal Misc. No. 19636 of 2016, whereunder the petitioner was directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Begusarai in connection with Garhpura P.S. Case No.

59 of 2014 on showing the receipt of the deposit of Rs. 14,54,000/- in the State Bank of India, Garhpura Branch. Learned counsel for the petitioner submits that while the petitioner was ready to deposit whole amount of Rs. 14,54,000/- in the State Bank of India on protest, but the petitioner is not in a position to deposit whole amount of Rs.14,54,000/- at the time of furnishing of bail bond.

Patna High Court Cr.Misc. No.40239 of 2016 (3) dt.19-10-2016 2/2 submits that the petitioner is ready to pay Rs. 5,00,000/- at the time of furnishing of bail bond and remaining amount would be paid within six months in three installments.

Learned counsel appearing on behalf of the O.P. No. 2 has no objection.

In view of the above submissions, the order dated 12.07.2016 passed in Criminal Miscellaneous No. 19636 of 2016 is modified to the extent that petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-IV, Begusarai in connection with Garhpura P.S. Case No. 59 of 2014 on showing the receipt of deposit of Rs.5,00,000/- in the State Bank of India, Garhpura Branch and also with undertaking that the remaining amount will be deposited within six months in three installments, if the petitioner is failed to deposit the remaining amount within stipulated period the bail of the petitioner would be cancelled. With the aforesaid modification, this application is disposed of.
