====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner, counsel for the informant and State.
The petitioner seeks bail in Kargahar P.S. Case No. 207 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
There is specific allegation against co-accused Sanjay Choudhary and Mannu Chaudhary of causing firearm injury to brother of the informant who subsequently succumbed to the injury. Petitioner along with other co-accused persons is alleged to have caught hold brother of informant in Khalihan.
Patna High Court Cr.Misc. No.74551 of 2018(2) dt.13-12-2018 2/2 Post mortem report shows only one entry and one exit wound of firearm on the person of the deceased. Counsel for the informant has appeared and opposed the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Kargahar P.S.
