From perusal of the impugned order dated 05-112014 passed in A.B.P. No. 912 of 2014, it would appear that when the court was inclined to call for the case diary on the prayer of learned Additional Public Prosecutor, the learned counsel of the petitioner insisted upon the court to pass order, on the basis of materials, available on the record and thereafter, the learned Sessions Judge passed the impugned order dated 05-11-2014. In view of the aforesaid facts, this petition stands disposed of with direction to the petitioner to file fresh anticipatory bail petition before the learned Sessions Judge, Buxar in connection with Simri P.S. Case No. 193 of 2014 and if, the petitioner files fresh anticipatory bail petition in connection with the above-said case before the learned Sessions Judge, Buxar, the learned Sessions Judge, Buxar shall pass appropriate order on the

Patna High Court Cr.Misc. No.225 of 2015 (2) dt.07-01-2015 2/2 anticipatory bail petition of the petitioner after perusing the case diary of above-said case.

Let the copy of the order be communicated to the court of Sessions Judge, Buxar court through fax at the cost of the petitioner.
