The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 447, 323, 307, 379 and 504 of the Indian Penal Code.

The prosecution case is that on 14.07.2015 at 7.00 P.M. the informant making protest for blocking the passage of the entrance of the house of the informant when petitioner no. 1 Sanjeet Paswan assaulted with Garasa on the head of the informant and petitioner no. 2 Manoj Paswan assaulted with lathi and when the informant fell down the other accused persons also assaulted and co-accused Kusheshwar

Patna High Court Cr.Misc. No.44974 of 2015 (3) dt.02-11-2015 2/2 Paswan snatched Rs.15,000/- from the pocket of the informant. It is submitted by learned counsel for the petitioners that the injury report suggests the superficial injury simple in nature caused by hard and blunt substance whereas it is alleged that petitioner no. 1 assaulted with Garasa and petitioner's side lodged Complaint Case No. 1292 of 2015 against the informant side at earlier point of time. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the nature of accusation in the background of dispute with regard to passage, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with A.P.M. P.S. Case No. 83 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
