2. The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 363/366(A) of the Indian Penal Code.
3. Prosecution case in brief is that on 05.07.2019, when informant's daughter (Daizy Kumari) was returning home, petitioner no.3 (Rajesh Kumar) and co-accused Suraj Kumar came on motorcycle and forced her to sit in his motorcycle and took her to Uttar Pradesh for the purpose of marriage. When the informant went to the house of petitioner to complain, they abused the informant.
4. Learned counsel for the petitioners submits that they have been falsely implicated in this case only because they happen to be family members of the co-accused Suraj Kumar
Patna High Court CR. MISC. No.21360 of 2025(3) dt.10-07-2025 2/2 who was in love with victim and kidnapped her. During investigation, the victim girl was recovered and in her statement recorded under Section 164 of the Cr. P.C. has not said anything against these petitioners. Police after investigation submitted final form against these petitioners. Petitioners claim clean antecedent.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within eight weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st Naugachia, Bhagalpur in connection with Bihpur P.S. Case No. 236/2019, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Singh, J) Saif/- U T
