Mr. Dinesh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Madhaura/Marhowrah P.S. Case No. 990 of 2020 registered for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code.

The accused/petitioner is named in the F.I.R. The allegation against the petitioner is to assist the main accused, namely, Akash Sah, who is alleged to have kidnapped the daughter of the informant.

Learned counsel appearing on behalf of the petitioner submitted that petitioner is elder of the main accused, namely, Akash Sah. It has further been submitted that petitioner, only being family member, has been implicated in this case.

No.33213 of 2021(3) dt.21-07-2022 2/2 Similarly situated accused Nirmala Devi and others have already been granted pre arrest bail by a co-ordinate Bench of this court vide order dated 15.06.2022 passed in Cr. Misc. No. 38923/ 2021. It has also been submitted that petitioner is person having clean antecedent.

Learned APP appearing on behalf of the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances as mentioned above, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail in connection with Madhaura/Marhowrah P.S. Case No. 990 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra, Saran, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
