====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 07-07-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Kumarkhand P.S. Case No. 87 of 2021 lodged under Sections 302/34, 201, 120 of Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submit present petitioner no.1 is the informant of the present case who has been made accused by the Police during investigation, whereas petitioner no.2 is the son of petitioner no.1. Learned counsel for the petitioners, further submit that petitioners are in custody since 24.12.2021. He also submits that petitioner no.1 was

Patna High Court CR. MISC. No.23470 of 2022(2) dt.07-07-2022 2/3 informant in this case but subsequently has been made accused in this case whereas the petitioners are alleged to be surrendered on 24.12.2021 having no criminal antecedent.

Learned counsel for the informant appeared and opposes the prayer for bail. Learned counsel for the state also appeared in this case and argued on the point that there is an apprehension if trial shall not be concluded the accused shall fled away.

Considering the facts and circumstances of this case that criminal case has been filed by the petitioner, considering their period of custody since 24.12.2021 and having clean criminal antecedent, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Iv, Madhepura in connection with Kumarkhand P.S. Case No. 87 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

The petitioners are directed that they shall appear on on each and every date before the Trial Court and shall not create any threat to the victim side, if it has been found so, the prosecution shall be at liberty to move for cancellation of his
