1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Akilpur P.S. Case No. 15 of 2019 dt: 19.03.2019 registered under Section 304(B), 201 / 34 of the I.P.C.
3. As per the first information report the victim lady has been killed for dowry on account of the fact that her father had refused to transfer the land in favour of his son-in-law. During investigation her dead body has been recovered from a gunny bag near railway bridge.
4. Learned counsel for the petitioner submits that the petitioner is the father-in-law of the deceased and resides at
Patna High Court CR. MISC. No.25090 of 2025(2) dt.25-04-2025 2/3 Danapur whereas offence has been committed at Saran. The fact that police has raided the house of the petitioner at Danapur itself goes to show that he does not stay at Saran and has falsely been implicated in the present case. He further submits that there was no demand of dowry as such no offence under section 304(B) I.P.C. is made out. He further submits that the petitioner resides separately from his daughter -in- law (deceased) and his son - Satyendra Rai, who is the husband of the deceased and has been granted regular bail by this court in Cr. Misc. No. 44190 of 2022 vide order dated 31.08.2022. He next submits that the mother-in-law, sister-in-laws (gotanis) and brother-in-laws of the deceased have been granted anticipatory bail by different co-ordinate Benches of this court in Cr. Misc. No. 63484 of 2019 vide order dated 09.01.2020, Cr. Misc. No. 48648 of 2019 vide order dated 05.08.2019 and Cr. Misc. No. 54744 of 2019 vide order dated 30.08.2019 respectively. The petitioner is in custody since 26.12.2024.

Regard being had to the submissions made by the parties, taking into consideration the fact that mother-in-law and other family members have been granted anticipatory bail, the husband has been granted regular bail and the petitioner is the father-in-law of the deceased languishing in custody since
Patna High Court CR. MISC. No.25090 of 2025(2) dt.25-04-2025 3/3 26.12.2024 accordingly I am inclined to grant regular bail to the petitioner.
6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chhapra in connection with Akilpur P.S.
