JUSTICE SATYAVRAT VERMA ORAL ORDER 13-05-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offences punishable under Sections 420, 467, 468 of the Indian Penal Code read with Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Allegation is of recovery of 11849.400 litres of liquor from a truck.

Learned counsel for the petitioners submits that the petitioners are in custody since 29.10.2021, charge-sheet has been submitted and are persons with clean antecedent. Learned

Patna High Court CR. MISC. No.23355 of 2022(2) dt.13-05-2022 2/2 counsel for the petitioners further submits that petitioners are the driver and the cleaner (Khalasi) of the truck and, as such, were not aware what the owner of the transporter had kept in the truck.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 29.10.2021, charge-sheet has been submitted, are persons with clean antecedent and taking into consideration the submissions made by the learned counsel for the petitioners, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Hajipur Industrial Area P.S. Case No. 189 of 2021.
