JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Koilwar P.S. Case no. 60 of 2013, registered under Sections 302/34 and 120-B of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that Rajesh Singh and Rajnish Singh, both sons of Sri Narayan Singh along with two unknown came on two motorcycles and opened firing in which Manoj Kumar Singh, brother of the informant, sustained fire arm injury and fell down. Thereafter, all the miscreants fled away from there by making firing in the air. The brother of the informant was rushed to the hospital, where he was declared dead. It is alleged that earlier Dinesh Singh, son of Narayan Singh threatened Manoj Singh, brother of the informant for dire consequences.
Patna High Court Cr.Misc. No.17998 of 2017 (4) dt.25-07-2017 2/2 Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, it has come in paragraph No. 43 of the case diary that brother of the petitioner was murdered at Ranchi in which the deceased had hand due to that reason, the petitioner was under conspiracy in the murder of deceased, brother of the informant. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Ara in connection with Koilwar P.S. Case No. 60 of 2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
