JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2019 The petitioner has approached this Court for a direction to the respondents to promote him to the post of Office Superintendent in Saharsa Collectoriate which has since been refused vide order dated 06.12.2018. From perusal of the order impugned, it appears that the service rules of Integrated Child Development Scheme has come into existence since 19.05.2014. According to the Rules, the cadre of the Clerk is district based. Necessary communication is being made at all levels for implementation of the aforesaid service rules. The petitioner has not provided sufficient inputs in the writ petition for issuance of any mandamus.

Patna High Court CWJC No.6630 of 2019(3) dt.19-06-2019 2/2 However, this Court deems it appropriate to direct that in case the petitioner makes a representation before the District Magistrate, Saharsa, within a period of four weeks, ventilating his grievances, the concerned respondent, i.e., Respondent No. 2, shall look into the matter and pass necessary orders in accordance with law, within a further period of four weeks thereafter.

Needless to state that the service rules of the Clerk Cadre of ICDS shall be taken into account while passing any order on the representation of the petitioner. With the aforesaid observation / direction, this petition stands disposed off.
