Complainant, Shila Devi filed complain petition putting an allegation that accused, Ganesh Ram, Rita Devi, Sona Devi (petitioner) and Ravindra Ram came to her place and asked for permission to engage her husband as a labourer and for that Rs. 300/- per day as wages was assured. In the aforesaid background, Ganesh, Ravindra along with one Md. Feroz took away Shivlal Ram on 29.07.2014 and since thereafter, he is traceless. It has been disclosed that Ganesh had come on the occasion of Chhath and handed over some articles who, on query, disclosed that her husband got down in the midway. So, informant apprehended murder of her husband.
There happens to be specific assertion in the complaint
Patna High Court Cr.Misc. No.40146 of 2016 (2) dt.20-09-2016 petition that on 29.07.2014, Ganesh, Ravindra along with Md. Feroz had taken away Shivlal Ram and so, the theory of last seen is found available against them.
So far petitioner is concerned, save and except having presence at the first occasion whereunder request was made to the complainant to allow her husband to be carried by them for menial work, on account thereof, petitioner, Sona Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of SDJM, West Muzaffarpur, in connection with Saraiya PS Case No. 485/2014.
