The petitioner seeks regular bail in connection with Muffassil P.S. Case No. 80 of 2021 dated 17.02.2021 instituted for the offences under Sections 419 and 420 of the Indian Penal Code read with Section 10 of Bihar Conduct of Examination Act, 1981.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.02.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant alleges that she was appointed as Centre Superintendent at Gauri Kanya High School, Manpur

Patna High Court CR. MISC. No.32852 of 2021(2) dt.29-11-2021 2/2 where some persons were caught impersonating others in matriculation examination and further some accused persons, including the petitioner, were appearing in the examination in place of original candidates and were apprehended. Learned counsel for the petitioner submits that the petitioner was a passer-by who by mistake had gone inside the examination centre and under mistaken identity, he was arrested. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.02.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffassil P.S. Case No. 80 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
