2. The petitioner seeks bail in Bhargama P.S. Case No. 384 of 2025 dated 11.03.2026, registered for offences under Sections 103(i), 302(2), 3(5) of B.N.S.
3. The allegation is that three unknown persons killed the elder brother-in-law of the informant. The police gathered the data dump of the area and the name of this petitioner transpired in the data dump having his location near the place of occurrence and at the time of occurrence. Thereafter, the petitioner was arrested and he confessed that not the petitioner but one Bablu Yadav assaulted the deceased in the course of cattle theft. Bablu Yadav has a different story to tell regarding the assault.
4. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering that there is no serious material against the petitioner except the confessional statement and presence in the locality may not lead to implication at this stage, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No. 384 of 2025.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
