It is surprisingly that the instant complaint case which has been filed in the year 2008 and being closed before charge vide order dated 13.05.2011 did not satisfy the hunger of the petitioner/complainant, who instead of availing so many dates in getting the witnesses produced, is more eager to continue with the trial at that stage alone and for that blamed the learned counsel engaged by him as well as the Advocate clerk instead of identifying his own conduct. Apart from this, in terms of Section 246 (6) of the Cr.P.C. the petitioner/complainant would have an opportunity to examine remaining witnesses, if he so desires and so, will have an opportunity. With the aforesaid observation, the instant petition is dismissed.
