JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 370, 372, 373 of the Indian Penal Code and Section 5 of Immoral Traffic Act. Petitioner is named in the first information report with allegation that he solemnized his marriage with informant with an intent to sell her. The petitioner is said to be person of third gender.

Submission on behalf of the petitioner is that even if the prosecution story assumed to be true, then also, suspicion has been raised against the petitioner.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.44674 of 2016 (3) dt.29-11-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Bhargama P.S. Case No. 36 of 2016.
