The petitioner, Pankaj Kumar @ Babloo, apprehends his arrest in Barachatti P.S. Case No.113 of 2013, registered under Sections 419 and 420 and other sections of the Indian Penal Code.

The In-charge Medical Officer raided six hospitals and alleged that they were run by untrained and fake Doctors. Learned counsel for the petitioner submits that the petitioner is not named in the first information report. Petitioner is alleged to be running Sai Dental Clinic, Itwan Bazar, but there is no document to show that the petitioner was running the clinic. The house owner disclosed that it was the petitioner, who was running the clinic. Other accused persons, namely, Dr. Rajesh Kumar and Dr. J.R. Das @ Jhaman Das @ Jhaman Rai Das, who

Patna High Court Cr.Misc. No.52227 of 2014 (2) dt.06-01-2015 2/2 were registered Medical Practitioner, have already been enlarged on anticipatory bail vide Annexure-2 series.

Perused the record.

Having considered the facts that the petitioner denied that he was running any clinic and the name of the petitioner came from the owner of the house, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sherghatti, District-Gaya, in connection with Barachatti P.S. Case No.113 of 2013, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Pawan/- U T
