JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 353/427/435/436 and other minor sections of the Indian Penal Code and Sections 150/151/152/146/174 of the Railway Act.
A boy died of accident with train. Allegation is that in protest a mob started disruption of the movement of the train. There is further allegation of burning a bogy of train. Twenty-three persons including the petitioners were identified as member of the mob.
Submission is that co-accused Ravi Prakash @
Patna High Court Cr.Misc. No.48162 of 2016 (2) dt.20-12-2016 2/2 Ravi Prakash Sharma and Mritunjay Kumar have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.47946 of 2016 and Cr. Misc. No. 47129 of 2016 on 16.11.2016 and 27.10.2016 respectively.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna Junction/Successor Court, in connection with GRP (Patna Jn. Railway) P.S. Case No.189 of 2016.
