Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code.
Petitioner is said to have demanded extortion money from the informant by sending him two separate letters which were found at the door of the informant but submission on behalf of the petitioner is that at the time of alleged occurrence, admittedly, petitioner was behind the bar in connection with a case of N.D.P.S. Act and as a matter of fact, the pairvikar of petitioner had taken his signature on several blank papers in the name of making pairvi in the case of N.D.P.S. Act and perhaps someone
Patna High Court Cr.Misc. No.45514 of 2016 (2) dt.19-10-2016 2/2 used the aforesaid blank papers for implicating the petitioner in the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that except the present case as well as one case of N.D.P.S. Act, petitioner does not have any other criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.P. Singh, Judicial Magistrate 1st Class, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 263 of 2015.
