The petitioner is apprehending his arrest in connection with Kathaiya P.S.Case no.17 of 2018, registered for offences punishable under Sections 448, 341, 323, 325, 307, 427, 386/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that he along with other accused persons came on the motorcycle to the house of the informant and abused and assaulted the wife of the informant on suspicion that she is Mukhabir of police. Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and no injury was found on the vital part of the body as well as the other accused persons have been granted

Patna High Court CR. MISC. No.21381 of 2019(5) dt.02-07-2019 2/2 privilege of anticipatory bail, vide order dated 20.7.2018 passed in Cr. Misc. No.43842 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM cum Sub Judge-II (West) Muzaffarpur in connection with Kthaiya P.S.Case No.17 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
