The petitioner apprehends his arrest in connection with Madhepura P.S. Case no. 342 of 2016, registered under Sections 341, 323, 307, 385 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 16.06.2016, in the evening, while informant was returning to his village from Raj Sonbarsa then in the way, petitioner and two others named in the F.I.R. stopped the informant and told their grievance about spreading the rumour about committing theft by them saying that they will not go in his ward, if he will pay ransom of Rs. One lakh. Yesterday in the evening, when informant Manoj Kumar reached near college chowk then petitioner along with Manikant Kumar and Sunil Kumar and four others caught

No.22257 of 2017 (5) dt.21-12-2017 2/2 hold him and started to abuse while informant Manoj Kumar tried to flee away to the clutches of them then firing was made, but anyhow the informant save himself by laying on the ground. At that time, Manikant pointed pistol at his head and this petitioner snatched his golden chain worth of Rs. 45000/- and wrist watch worth of Rs. 7000 and cash of Rs. 25000 from the pocket of the informant. Learned counsel for the petitioner submits that petitioner and two others are resident of same village and due to election rivalry of Panchayat, the informant who was candidate of ward member has lodged this false case against the petitioner and others.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 342 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
