JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-12-2022 Though the present writ petition has been filed for granting priority to the petitioner in appointments to be made pursuant to issuance of advertisement no. 85/2014, which was published by the Respondent-Bihar Public Service Commission in the daily newspaper on 12.11.2014 for making appointment on 10 posts of Assistant Forest Conservator, however, with the efflux of time as also on account of selection process having

Additionally, it is submitted by the Ld. Counsel for the Respondents that Clause 6(d) of the Bihar Forest Service Rules, 2013, clearly stipulates that a candidate seeking appointment on the post of Assistant Forest Conservator should possess a graduate degree from a recognized University or equivalent at least in one subject i.e. Botany, Chemistry, Forestry, Geology, Mathematics, Physics, Statics and Zeology or graduate in Agriculture or Engineering, hence, there is no provision in the Rules for providing priority to a candidate possessing graduate degree in the subject Forestry, hence, the prayer of the petitioner is not tenable in the eyes of law. Accordingly, the present writ petition stands dismissed.
