The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the younger brother of the informant had gone with Vijendra Kumar in the morning for walk, the informant heard hulla that four accused persons had shot him dead. On reaching the place of occurrence he saw his brother in an injured condition who on being taken to the hospital died.

It is submitted by learned senior counsel appearing for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in the confessional statement of a co-accused made before police which is not

It is further submitted that the FIR named witness Vijendra who is stated to be along with the deceased brother of the informant did not name the petitioner herein. The petitioner is in custody since 12.1.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation together with the petitioner having remained in custody for more than 11 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Dulhin Bazar P.S. Case no. 211 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M-Ist Class, Danapur, Patna.
