JUSTICE BIRENDRA KUMAR ORAL ORDER 11-05-2017 Petitioner no. 2, Birendra Nut, has already been arrested in this case, hence, his prayer for anticipatory bail is dismissed as withdrawn, on submission of the learned counsel for the petitioners. Heard the learned counsel for the petitioner and the State.

This is a petition for grant of anticipatory bail for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

According to first information report, from the field of some other person a mixture of mahua and jaggery was recovered. The villagers are under suspension, including the petitioner.

Case No. 222 of 2016 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
