JUSTICE SHIVAJI PANDEY ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Sour Bazar P.S. Case No. 42 of 2019 registered for offence punishable under sections 363 and 366(A)/34 of the Indian Penal Code.

Allegation has been made that the present petitioner along with other accused persons kidnapped the victim girl. Learned counsel for the petitioner submits that both are major and they have voluntarily entered into marriage but in the statement recorded under section 164 Cr.P.C., she has stated that she was forcibly abducted and she was put to sexual assault itself reflects in what manner the girl has been treated by the

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected.
