JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 05.06.2016 in a case registered under section 304-B, 201/34 of the Indian Penal Code. The marriage of petitioner had taken place with the deceased four years ago and after marriage, the deceased gave birth to two children and the second child of the deceased was aged about two months at the time of death of the deceased. In course of investigation, the statement of one Ram Ikbal Rai, who happens to be nebighour of the petitioner, was recorded at para -8 of the case diary and the aforesaid witness specifically stated that deceased and petitioner were leading happy and peaceful married

Patna High Court Cr.Misc. No.37592 of 2016 (3) dt.10-11-2016 2/2 life except some wear and tear of the life. In course of investigation, some witnesses stated that deceased was caught in fire accidentally and while she was being taken to hospital, she died on the way and, after that, petitioner and his family members disposed of dead body of the deceased without giving any information to her parents. The investigation against the petitioner has already been completed and submission on behalf of the petitioner is that the above stated statement of witnesses goes to show that there were no differences between the deceased and petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jurawanpur P.S.Case No. 22 of 2015.
