The petitioners pray for bail in Turkauliya (Banjaria) P.S. Case No. 330 of 2016 registered under sections 272 and 273/34 IPC including sections 47/54 of the Bihar Excise (Amendment) Act, 2016.
The S.I. of Police lodged the case stating therein that a motorcycle was intercepted whereafter both persons riding the motorcycle started fleeing away, but they were apprehended on a chase. From the possession of the petitioners six litres of illegal country-made liquor was recovered.
It is stated that the petitioners are in jail custody since
Patna High Court Cr.Misc. No.47593 of 2016 (3) dt.07-12-2016 2/2 30.07.2016 having no previous criminal record of having indulged in similar kind of offence.
In the facts and circumstances of the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of CJM-XII, Motihari in Turkauliya (Banjaria) P.S. Case No. 330 of 2016 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, the petitioners shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel their bail bonds and secure their arrest in accordance with law.
