It is submitted by learned counsel for the petitioner that by order dated 26.6.2020, the petitioner was directed to be enlarged on provisional bail in connection with Uchkagaon P.S. Case no. 235 of 2018 pending in the Court of learned 1st Additional District & Sessions Judge-cum-Special Judge, Excise, Gopalganj. He has been so released. Although the affidavit etc. for removal of the defects pointed out by the office are ready, the physical functioning of the Court not having commenced, he is unable to file the same and thus the defects could not be removed.

In the facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated

Patna High Court CR. MISC. No.21025 of 2020(5) dt.08-02-2022 2/2 26.6.2020 in the instant case in connection with Uchkagaon P.S. Case no. 235 of 2018 to the satisfaction of learned learned 1st Additional District & Sessions Judge-cum-Special Judge, Exise, Gopalganj is hereby confirmed.

The petitioner is directed to remove the defects within four weeks of the normal physical functioning of the Court being restored.
