2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 305 , 331 ( 4 ) of BNS.
3 . The prosecution case in brief, is that on the alleged date and time of occurrence , some unknown miscreants committed theft in the house of informant and his brother. It is further alleged that they committed theft of 01 LCD, some ornaments, land papers and other documents, etc .
4. It is submitted on behalf of the petitioner that petitioner is quite innocent and has committed no offence as alleged. The name of petitioner transpired during course of investigation in the confessional statement of other co-accused
Patna High Court CR. MISC. No.21430 of 2025(2) dt.30-04-2025 2/2 persons. No stolen article has been recovered from possession of this petitioner and he is in no way connected with the alleged occurrence . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that no stolen article has been recovered from the possession of this petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class, Jamui in connection with Chandramandih P.S. Case No. 160 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
