Such permission is accorded.

Accordingly, the application of petitioner no.1, Rajeshwar Kewat, is dismissed as withdrawn.

Heard learned counsel for the petitioners no. 2 to 4 and the learned A.P.P. for the State.

The petitioners no. 2 to 4 apprehend their arrest in connection with Laukariya (Patkhauli) P.S. Case No. 23 of 2014 registered under Sections 147, 148, 341, 342, 323, 447, 307, 302, 379, 504 and 506 of the I.P.C.

The accusation is that Raja Kewat, Munib Kewat, Gobind Kewat, Pulind Kewat, Manoj Kewat and Rajeshwar

Patna High Court Cr.Misc. No.47046 of 2015 (2) dt.16-10-2015 2/2 Kewat came armed with lathi and stick at the door of the informant and caused injury to his father Hira Kewat, who died on the spot. When the informant raised alarm, he was also assaulted by them and when his wife rushed there, she was also assaulted by them. Later on, Durga Devi, Rina Devi, Muali Devi, Atima Kumari and petitioners Inari Devi, Muna Devi and Shanti Devi also reached there armed with lathi and started assaulting and on intervention of villagers, they fled away.

Learned counsel appearing on behalf of the petitioner submits that the petitioners, who are ladies, have falsely been inserted in the F.I.R. with general allegation of assault later on.

Having considered the facts and the circumstances of the case, let the petitioners no. 2 to 4, above named, in the event of their arrest or surrender within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Bagaha, West Champaran in connection with Laukariya (Patkhauli) P.S. Case No. 23 of 2014, subject to the conditions laid down under Section 438(2) Cr. P.C.
