2. The petitioner apprehends his arrest in Musarigharari P.S. Case No. 55 of 2021, registered for the offences punishable under Sections 304B, 498A/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

3. Allegation against this petitioner is that he along with other FIR named accused persons committed torture and harassment upon the daughter of informant for dowry. It is further alleged that the accused persons ultimately killed the daughter of informant by pressing her neck. Petitioner is the husband of deceased.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. No such

Patna High Court CR. MISC. No.23265 of 2023(4) dt.17-08-2023 2/2 occurrence has ever taken place and there was no demand of dowry by the petitioner. In fact, the deceased committed suicide by hanging herself. There is general and omnibus allegation. Petitioner claims clean antecedent.

5. Learned APP however, vehemently opposed the prayer for bail.

6. Considering the facts aforesaid and the nature of allegation and the fact that petitioner is husband of the deceased and deceased died in unnatural circumstance within seven years of marriage at her matrimonial home, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
