The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code. It is alleged that minor girl of the informant has been abducted by all the F.I.R named accused persons including the petitioners.
It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case since they are parents of co-accused Nilesh
Patna High Court CR. MISC. No.23288 of 2022(3) dt.22-11-2022 2/3 Kumar Chaudhary with whom the victim was in love. The daughter of the informant herself compelled the son of the petitioners to flee away from their houses for the purpose of marriage and ultimately both were married willfully and live together as husband and wife in Kolkata. The informant also used to visit at the house of his daughter at Kolkata. Moreover, the same very informant has also lodged Narayanpur P.S. Case No. 3 of 2018 under Sections 498(A), 306 of the Indian Penal Code against the petitioners and their son and in this case the petitioners are already on bail.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani in connection with Bisf
