The petitioner seeks pre-arrest bail in Banka P.S. Case No.437 of 2018 registered for the offence under Sections 341, 323 and 354(B)/34 of the Indian Penal Code.

Accusation is that on 27.06.2018 at 11.00 A.M. while the informant Geeta Devi was preparing mid day meal Shambhu Mirdha and the petitioner came in the kitchen and started hurling abusive language and also tried to commit outrage her modesty upon which she raised alarm and on hearing hullah children of the school and teachers came there thereafter both accused fled away.

Learned counsel for the petitioner submits that, in fact, the petitioner was also a cook at the time of occurrence in

No.20231 of 2019(5) dt.25-07-2019 2/2 the school whereas the informant was also a cook and due to some differences arose between the husband of the informant and the father of the petitioner on the point of supplying firewood for preparation of mid day meal in the school to which a Complaint Case No.907 of 2018 has been filed by the father of the petitioner which would appear from Annexure-2 to this petition.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Banka, in Banka P.S.Case No.437 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
