JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-10-2020 Considering the nature of allegation and the fact that the petitioner is in custody in connection with Sherghati (Dhobi) P.S. Case No. 573 of 2019 for the offence under sections 306 and 34 of the Indian Penal Code, the Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. However, the court below is directed to dispose of the regular bail if filed by the petitioner on surrender on its own merit on the same day without being prejudiced by the refusal to grant anticipatory bail to the petitioner.
