The petitioner is apprehending his arrest for the offences instituted under Sections 467,468,469,471,420,406,409,120B/34 of the Indian Penal Code.
The prosecution story, in brief, is that the petitioner with other co-accused persons in planned way has got withdrawn of Rs. 5,00,000/- from the account of Nutan Devi and committed defalcation from the Bank Account. During internal audit of bank, the aforesaid withdrawal was detected and thereafter Nutan Devi lodged the written complaint claiming illegal withdrawal of Rs. 5,00,000/-.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has been made accused due to mistake of fact. He was not manger at the relevant
Patna High Court Cr.Misc. No.657 of 2015 (3) dt.03-09-2015 P2/2 time. Petitioner is not named in the First Information Report. His name has come during the course of investigation. The petitioner is ready to deposit an amount of rupees thirty-five thousand in the Court below which shall be subject to final disposal of the case On behalf of the State it has been submitted that the petitioner is named not in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that petitioner shall deposit an amount of rupees thirtyfive thousand in the Court below which shall be subject to final disposal of the case, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Madhepura P.S. Case No. 70/14 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
