The present writ application has been filed by the petitioner for challenging the order dated 25.10.2018 passed in Appeal Case No.57 of 2017-18 by District Magistrate, Muzaffarpur dismissing the appeal and affirming the order dated 05.10.2017 contained in Memo No.1331 passed by District Programme Officer, Muzaffarpur.

3. Counsel for the petitioner submits that the order passed by the DPO relating to appointment of Anganwari Sevika/Sahaika at Centre No.160, is in gross violation of natural justice and the said order was passed behind her back.

4. Counsel further submits that in the appeal, the appellate authority had heard the matter, but refused to interfere in the order passed by the DPO.

5. Counsel for the State submits that a reasoned order has been passed by the District Magistrate, Muzaffarpur in which the grounds for non-interference in the order passed by the DPO, have categorically been mentioned.

Upon perusal of the reason mentioned by the District Magistrate, this court is of the view that it has rightly been decided that the merit list was published in 2013, and therefore, there is no need to order for fresh appointment. Hence, there is no need of any interference in the order dated 25.10.2018 passed in Appeal Case No.57 of 2017-18 by the District Magistrate, Muzaffarpur.

7. Accordingly, the present writ petition stands dismissed.
