The petitioner seeks bail in connection with Mehshi P.S Case No. 100 of 2016 registered for the offences punishable under Sections 272, 273, 290/34of the Indian Penal Code and section 47 (a) of the Bihar Excise (Amendment) Act. Allegedly, from possession of the petitioner two liters country made liquor prepared from sprit was recovered and for that the petitioner is in custody since 08.07.2016. In the facts and circumstances stated above, considering the detention of the petitioner, he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction

Patna High Court Cr.Misc. No.41786 of 2016 (2) dt.06-10-2016 2/2 of the learned 6th Additional Chief Judicial Magistrate at Motihari, East Champaran, in connection with Mehshi P.S. Case No. 100 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
