====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Matihani P.S. Case No. 131 of 2018 instituted for the offence under Section 414 of the Indian Penal Code, Sections 20/22 of N.D.P.S. Act and Section 30(A) of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that from Bhuskar of the petitioner, total 32.340 liters of foreign liquor has been recovered.
The seizure list is part of the First Information Report. It appears that two other seizure list were prepared from which 250 grams of Ganja has been recovered from Saurabh Kumar who was found sitting in Tavera vehicle. Similarly, on third seizure list, it appears that huge quantity of foreign liquor has been recovered from Tavera vehicle on
Patna High Court Cr.Misc. No.76199 of 2018(2) dt.18-12-2018 2/2 which two other persons namely, Dharamveer Kumar and Saurabh were found sitting.
Petitioner is in custody since 8.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Begusarai, in connection with Matihani P.S. Case No. 131 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
