The petitioner, (1) Budhia Devi (2) Manju Devi, are in custody since 11.08.2016 in Misc. Case No.48 of 2016 under Section 47(a) of Bihar Excise (Amendment) Act, 2016. According to the prosecution case, from the compound of the petitioners, three containers were recovered one containing Gur kept for fragmentation and in one plastic jerking wine, illegal wine of three litres and one machine was recovered. Both the petitioners are ladies and in custody since 11.08.2016.

Considering the above facts and the quantity of recovery and period of detention, I direct that the above named petitioners

Patna High Court Cr.Misc. No.39010 of 2016 (2) dt.17-09-2016 2/2 be released on bail on furnishing bail bond of Rs.5,000/- (Five thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Misc. Case No.48 of 2016.
